អតិថិជនរបស់យើង បានទទួលសេចក្តីសម្រេច លើកលែងការចោទប្រកាន់ ពីតុលាការទីក្រុងប៉ារីស ថ្ងៃនេះ ដោយក្តីរំភើបក្រៃលែង។

តាំងពីជាង ២០ ឆ្នាំមកហើយ សម រង្ស៊ី លាតត្រដាង និងថ្កោលទោសបទឧក្រិដ្ឋ ប្រព្រឹត្តដោយរដ្ឋអំណាច នៅប្រទេសកម្ពុជាសព្វថ្ងៃ ហើយគាត់តស៊ូ ដើម្បីលើកតម្កើងលទ្ធិប្រជាធិបតេយ្យ។

សម រង្សុី ត្រូវបានគេបង្ខំឲ្យនិរទេសខ្លួន ហើយឧបករណ៍នយោបាយរបស់គាត់ ត្រូវបានដកហូតដោយ ហ៊ុន សែន ដែលប្រើមធ្យោបាយគ្រប់បែបយ៉ាង ដើម្បីប៉ុនប៉ងបំបិទសំឡេងរបស់ សម រង្ស៊ី។

តាមរយៈ ការប្រកាសថា សម រង្ស៊ី គ្មានទោសកំហុសអ្វីទេ តុលាការប្រទេសបារាំង ទទួលស្គាល់ជាឱឡារឹក ថាការតស៊ូរបស់ សម រង្ស៊ី ជាការតស៊ូត្រឹមត្រូវ ហើយតុលាការ ក៏បានការពារសិទ្ធិសម្តែងមតិរបស់គាត់។

តុលាការបញ្ជាក់ថា សម រង្ស៊ី មានទឡ្ហីករណ៍គ្រប់គ្រាន់ ដើម្បីអះអាងថា ហ៊ុន សែន នៅពីក្រោយការធ្វើឃាត មកលើមេសហជីព ជា វិជ្ជា។

ជាទូទៅជាងនេះ ចៅក្រមកត់សម្គាល់ ពីបរិបទហិង្សានយោបាយ និងពីការធ្វើឃាតក្រៅប្រព័ន្ធតុលាការ ដែលមានតាំងពីជាង ២០ ឆ្នាំមកហើយ នៅប្រទេសកម្ពុជា។

ចៅក្រម ក៏បានរំលឹកផងដែរ ពីរបាយការណ៍របស់អង្គការការពារសិទ្ធិមនុស្ស ពីការស៊ើបអង្កេតរបស់អ្នកសារព័ត៌មានឯករាជ្យ និងពីការប៉ុនប៉ងសម្លាប់អតិថិជនយើង (សម រង្សុី) ក្នុងឆ្នាំ ១៩៩៧។ ករណីប៉ុនប៉ងធ្វើឃាតនេះ នឹងនាំឲ្យមានការកាត់ក្តីមួយ ក្នុងពេលឆាប់ៗខាងមុខនេះ នៅចំពោះមុខតុលាការព្រហ្មទណ្ឌកម្រិតឧក្រិដ្ឋ (Cour d'Assises) នៃទីក្រុងប៉ារីស។

សម្រាប់អតិថិជនយើង សេចក្តីសម្រេចថ្ងៃនេះ របស់តុលាការ មិនមែនគ្រាន់តែជាជ័យជំនះផ្ទាល់ខ្លួនមួយទេ តែជាការនាំមកផងដែរ នូវសេចក្តីសង្ឃឹម ដល់អ្នកការពារសេរីភាព និងយុត្តិធម៌ នៅប្រទេសកម្ពុជា និងប្រទេសដទៃទៀត។

Statement from Sam Rainsy’s lawyers

October 10, 2022

Our client has welcomed the two acquittals given today by the Paris tribunal judiciaire with great emotion.

For more than 20 years, Sam Rainsy has denounced the crimes committed by the Cambodian regime and has fought to promote democracy.

Forced into exile, all his political levers have been removed by Hun Sen, who has tried every means to silence him.

In acquitting Sam Rainsy, the French justice system has solemnly confirmed the legitimacy of his actions and defended his freedom of expression.

The tribunal indicates that it has sufficient elements to affirm that Hun Sen was the originator of the assassination of trade union leader Chea Vichea.

More generally, the judges underline “the context of political violence and extrajudicial execution” which has existed for more than 20 years in Cambodia.

They draw attention to the reports of human rights organizations, the investigations of independent journalists and the attempt to assassinate our client in 1997.

On this latter matter, a trial will be held at the Paris Cour d’Assises.

For our client, this judgment is much more than a personal victory, but is a ray of hope for defenders of freedom and justice in Cambodia and elsewhere.
